All complaints about the conduct, health or competence of a nurse or midwife made to NMBWA are initially assessed the NMBWA Complaints Assessment Committee or the Impairment Review Committee as well as by NMBWA’s Professional Governance team. An investigator may be appointed.
The investigator then interviews the complainant, any witnesses and the nurse/midwife against whom the complaint is made. All relevant documentation in relation to the complaint is reviewed and a report compiled.
On receipt of the investigators report, NMBWA will then determine whether:
- any further action is necessary
- to refer the case to the State Administrative Tribunal
- to refer the nurse or midwife for an independent health assessment
- to assess the competence level of the nurse or midwife
The principles of procedural fairness are applied throughout all processes of investigation and hearings of nurses and midwives registered with NMBWA. All parties are kept abreast of the process and will be advised as to the outcome of the complaint and the assessments undertaken.
